911 calls could be admitted into Casey Anthony murder trial

Orlando, FL – Casey Anthony may be face-to-face with her mother and brother this week if they take the stand in an Orlando, Florida courtroom. Cindy Anthony and her son Lee may testify at a hearing Thursday afternoon.  The State is expected to argue that 911 calls placed by Cindy Anthony in July 2008 should be admitted at her daughter’s murder trial next year. The defense says the taped phone calls are hearsay and should not be admitted.

 The hearing comes two years after two-year-old Caylee Anthony was reported missing on July 15, 2008.  Casey Anthony’s family had not seen Anthony or her daughter since June 16, 2008. When Cindy Anthony found her daughter a month later, Caylee wasn't with her. Cindy Anthony threatened to call the police, hoping the threat would force Casey Anthony to describe where her daughter was. After two calls were placed to the police, Casey Anthony admitted to her brother that she hadn't seen Caylee in 31 days and that she believed her daughter was with the nanny, Zenaida Gonzalez.

The third and final call was placed immediately after Cindy Anthony overheard what Casey Anthony told her brother.  Cindy Anthony appeared to be agitated and excited as she told the dispatcher that her granddaughter had been missing for a month and that her daughter’s car smelled “like there’s been a dead body” in it.

Cindy Anthony has since explained that the odor emanating from the car could have been from rotting garbage. However, the State believes that Caylee’s decomposing body was in the trunk of the car at some point in late June 2008.

Caylee's skeletal remains were found in the woods about one quarter mile from the Anthony home in December 2008.

The State intends to prove at trial “the progression of [Anthony’s] lies about the fate of her daughter.” These 911 calls are a critical part of that progression. “It is only in the face of repeated threats by her mother to contact authorities and falsely accuse her of a crime, that [Anthony] finally fabricates the ‘Zanny story,’ prosecutors asserted in their papers.  In the calls, Cindy Anthony reported that Casey Anthony stole the car, which was not true.

Thursday’s hearing is also expected to focus on a motion from the defense.  They’ll ask the judge to modify a ruling by Judge Stan Strickland, who stepped aside in April. The motion concerns a review of documents from Texas Equusearch, a private company that assisted in the search for then-missing Caylee. While Strickland’s order allowed the defense attorneys to review thousands of documents created by TES, the attorneys were prohibited from taking notes during the review. The defense maintains the current arrangement is inefficient and they’re seeking a more workable resolution.

Tape recordings are not hearsay but recorded evidence. Hearsay is repeating what someone told you – without that person being available for cross examination. As well, when calling 911 you are giving your consent to be recorded by placing the call. Therefore, what you say is being documented and may be used later. NO WAY is this hearsay!!!

I'm wondering if Cindy has another 'meltdown' on the srand like she did during depositions. This new judge won't, I believe, allow the same attitude that she provided last time she was sworn in. And , please, Cindy, if you read this, get rid of the gum. You look like a cow chewing her cud. Suck on some hard candy. And, yes, the 911 tapes should be admitted as evidence. Cindy placed the call and anyone listening can hear the hysteria in her voice. Let's get this show on the road, OK?

most definitely allow the tape. It is the first piece of evidence to the police that the Child is missing.

Cindy had NO reason to believe that anything or anyone dead had been in that car. She spoke truthfully on that call. And has been deceptive ever since.

Is this that sub par intelligence lawyer that Casey has trying to keep out all evidence? we should call him the smiley attorney : )

I think where hearsay comes into this is that in the 911 calls, Cindy Anthony is saying what she overheard in the conversation between Casey and her brother. She is not stating that she knows as fact because she witnessed something first hand. She is stating her thoughts on the conversation she overheard. That's where the hearsay clause comes in...I think. Maybe I am wrong.

The defense is just refuting everything argued because they have nothing to lose. They are going to pull out all the stops they possibly can because the evidence is so plentiful against her.

I can't even imagine that anyone could argue that the tapes should not be admitted. It is clearly the mother on the phone and the panic in her voice was 100% genuine. This is concrete evidence in the case and they are not allowed then I believe that is an injustice. However, no matter in or not, she will be convicted of murder. I believe in "Innocent Until Proven Guilty" but give me a break here.

They are heresay because in the recordings, the content is the person on the phone saying what she was told by someone else. Since the "someone else" isn't the person on the phone, all that testimony is heresay.

The defense isn't claiming them as hearsay because they're tape recordings. It's because the mother was reporting on something that her daughter didn't tell her. The daughter told the brother, and the brother told the mother. Any evidence the mother provides on that subject is hearsay unless the brother testifies and can be cross-examined. Consent and documenation are not the issue here.

I think what they are claiming as hearsay is what Cindy said in the 911 call not the call itself. In that call she repeats what Casey told her and that I guess could be hearsay in the eye of the law. I don't think it will matter if it is allowed or not. Everyone in America has heard it and they won't forget it.

I believe they mean that what is being said on the 911 tapes is hearsay, not the tapes themselves.

that's the defense for ya. they'll say anythind to get some hard evidence thrown out of court to try and win the case. if they win, they score more money. it's not about the right or wrong for the DA, it's about how much money they make per the amout of cases they win. that's why a lot of them either quit or become judges. their careers are based on wins.

The recordings are absolutely hearsay. Hearsay is any out of court statement offered to prove the truth of the matter asserted. It doesn't matter if the statement is in the form of a recording. However, there are a number of exceptions to the hearsay rule and the prosecution will try to get the recordings in under one of the exceptions.

I think the mother and brother will be more than willing to perjure themselves rather than throw Casey on the chopping block. I think her parents know full well what she did to that child, but their minds just won't allow them to go there completely. It will happen after the trial, but give it a very long time before they all accept what happened to that child.

EVEN IF we take it as "true" that the 911 calls are "hearsay;" it still doesn't matter. Under a hearsay exception of "excited utterances"; it will be allowed in. JB & "dream team" are just submitting this motion which is an exercise of futility, imo. OF COURSE, these calls come in!!

Anyone else wonder WHY the heck Cindy even bothered to call 911 2 years ago tomorrow? Ever since then, she & her hubyy have done a 180, claiming Casey is innocent. Yet, they aren't looking for the "real killer." I used to feel sorry for them, but not anymore. If Cindy never made those calls, the world would most likely not know a thing (if much) of this case. WHY bother calling the cops when now you have an explanation of "I was just trying to get the cops there faster."

ONCE SHE CALLED POLICE, her daughter was done. If she really wanted to "save" the psychopathic, pathological liar, she shouldn't have made the calls. Now she regrets it even though her granddaughter is DEAD!

George too – telling FBI & police he knows "what a dead body smells like" and that was the smell in the car"; he too now says "i'm not THAT sure (or something of that nature).

Give it up Casey, parents & "dream team." She may not get the DP, but do you really want to take that chance? You are very foolish considering the evidence is overwhelming!

This is just another ploy by the defense to suck more money out of the tax-payers pockets. The more motions they present, the more money they make. Being thorough is no justification for robbing the State. They can't remake the laws! Casey is no better than any other criminal in custody and the rules will not change for her. I suspect that every piece of evidence will have a motion attached to it. Ridiculous!

Hearsay is any out of court statement used to prove the truth of the matter asserted. Meaning if it was not made while under oath in the courtroom, it is hearsay if you are using the statement to prove what is being said in the statement. There are exceptions which the State is saying applies in this case, but it is hearsay.

What about poor caylee? I hope that Judge perry say no to them and say's yes they will use them; in court for evidence. Casey is the one that put herself in this mess and she derserves the death penalty.
Poor caylee never got a change in life because of Casey So I hope that the judge will have justice for Caylee. She's the one that derserves it not Casey. Why did she wait 31 days? Lieing to the cops and giving them the run around. Doesen't Florida have some laws that they should go by. So yes the 9-1-1- tapes should come in

Sorry Chris, but all out of court statements–including recordings and even written documents–can be hearsay. 911 calls are an especially difficult case. Regardless of Casey Anthony's culpability for her daughter's death, her lawyers are doing their job in challenging the 911 calls' admission into evidence.

I would be very surprised if the State should loose this case.
1) Why would Casey Anthony need a nanny? Was she working at the time? If so, were and if not, she would have no money.
2) The first thing you do when your child goes missing is call your family and police
3) The 911 Calls from Casey's mother are crutial to the case. They show that her mother herself is worried that her own daughter may have had little Kalee's body in the trunk
4) Forsensic found evidence of hair folicle that proved that a dead body was in the trunk.
5) In the trunk they found traces of clorofhom which also happen to
be a hot topic in the "google search engine"
6) You look for your missing child not party! When she was realed from Jail she never made any attempts to find her..no public plea..nothing!
She has no emotion. Everything is about her not her daughter. She believes herself to be a victim...egotistical liar et.........she should be dead!

Funny... how they were ONLY concern for their grand daughter, and justice for her in the beginning. But when they realized the murderer is their own daughter, they cover the daughter and FORGET they had a grand daughter.
Cindy and George are in denial that they were not perfect parent. It's sad what a parent will do to protect.. or should we say enable a child to continue manipulation... now of the court system.

i have watched in session also know as court t.v. for years, and i have always heard the 911 calls..how this this be hearsay ??? it is recorded by a 911 operator.. i think this is called "excited utterence"! i want to see CINDY on the stand and see if she pulls the same crap she pulled at the deposition hearings!!! hope judge perry puts her in her place in a damn hurry !!this is justice for "CAYLEE" not "CASEY"!!!!

I sincerely believe Casey is responsible for Cayle's death. I think she tried to put her to sleep for a while so that she (Casey) could party. When she returned to her daughter, she was dead and she didn't know what to do. Casey doesn't seem to want anything to interfere with her life, so she makes up stories and does not think she is accountable for her actions. I think Mom & Dad have protected her and helped in covering up things in the past and she expects them to do the same in this incident. Unfortunately the only thing important to Casey is Casey. I don't think she intentionally killed her daughter, but she felt no guilt or shame. She just wanted to move on and forget her.

I think the only honest comments Cindy ever made were at the very beginning of this ordeal, starting with the phone calls and also her conversations with Casey in jail when they were visiting her and asking so many questions. After that, everything that came out of Cindy's mouth was a lie to cover for her daughter. I feel George did the same. The only one who seems to not want to be involved with Casey's lies is her brother, who seems to have totally removed himself from the whole thing. I also think Casey spent those 31 days looking for an attorney to represent her, and she certainly found one of the sleaziest in Mr. Baez. I hope Judge Perry allows all of this into trial.

I belive that any recording made to the 911 opertor should be used in court because Cassey knew what had happened to her daughter and that she was trying to cover every thing up . Cassey has not shown enough emoition about her real feelings .

My comment is simple. The tapes should be let in for the simple fact it shows Casey’s none emotional connection. No I do have a question why haven’t the police checked into Lee Anthony, Due to the fact at one point and time at the funeral Lee made the statement to Casey that he would take care of things and not to worry. A few of the in sessions analyst thought he was talking in code to his sister. In my opinion I think she told him where the baby was and he went and got the body put it where they found it after the search to throw everyone off Casey and to say others planted evidence. He seems like the type of person who would o it. It’s my opinion.

I think casey shoud take a plea deal,, there is no way out for her at this point in time,,,,, murder 2 15- to life,,, with no possibility of parole,,,
these motions are just a stall tactic,,this should be interesting today, since lee will be there face to face with casey since the beginning,,, cindy i think will crack under the pressure.

CMA means Casey!!! At the funeral what "promise" is he going to keep?? If to Caylee-what promise would he still be able to keep?? The only one I could even think he would have had was to protect her and that can't happen, if it was Cindy it wouldn't be on national tv. So I think that he "moved' the body after Casey was arrested and that is the promise not to tell so she can walk free. And now if he 'believes' everything she says then he must believe that he molested his own sister and this is the payback by helping her hide the baby she won't tell on his molestation against her. This is in regards to the Casey Anthony case.

I can not believe that it has been 2 years to the day that Caylee disappeared. And still NO trial. Right now, I don't think there will be a trial next year. At this rate, she will die of old age in prison, before she goes to trial.

If it was someone else, this trial would already be over. Just because Casey is a young and beautiful lady, should have nothing to do with the case.This case is going to cost the State of Florida millions of dollars.

The defense team seems to be dragging their feet, making motions at this late date.

I keep hearing comments on the 911 call made by Cindy Anthony regarding her daughter's car & the smell. It is assumed that Cindy knows the smell of a dead body because she is a nurse. That is not necessarily true. Remember working as a nurse means working with live patients and even if your patient expires, you never leave them in the room long enough for them to start "smelling". I am a nurse and we always removed the bodies from the room as soon as the family had a chance to say goodbye.

Although this in no way would excuse Casey anthonys actions, has anyone looked into the allegations of sexual abuse? I have read some of the letters Casey's father had written. To me it is clear that some of of the comments are penned from a lovers need not a fathers heartbreak.

So if I understand this correctly, Mrs. Anthony is on the stand saying that she told the police that Casey stole the car she bought from her brother just so she could get the police to get Casey and the granddaughter together with her because she hadn't seen the kid in weeks?

Isn't that making a false statement to the police? And isn't that in itself a crime?
Also the dead body smell – is she claiming that she just said that to get a response from the police? She's saying a lot of wild statements just to get the police "out there, right now"

I am so fed up with Jose Baez and his team filing motions after motions. They are so well known for doing this instead of getting right down to business and get going with the trial. As far I am concerned, Jose Baez has not accomplished anything for the past two years except for being famous for filing motions! As far I am concerned, they need a good swift kick in their butt and a bang over their heads with Judge Perry's gavel For the life of me, what college of law did Baez and his team come from and how in the world did they past their bar exams???

I believe those 911 calls should be entered into the trial as evidence. As a former 911 Emergency Communications Employee we were always told that everything said via the phone or radio was available for public listening and that also what we were saying, asking or hearing was admissible in any court hearing or trial. We were also told that we could even be called to court to verify what was being said was accurate and what the caller was saying was in fact valid, no modifactions had been made to the recordings.

I've been following this for sometime now and I have to say that this is a classic example on how law enforcement should not interact with the press. I base this on 30 some years of experience. Law enforcement are nullifying their own jury pool, and have already shown that they are tainting their own witnesses future testimony by public releases of possible witness statements that other witnesses can see and hear. Evident by the change of story by one witness concerning the smell. They have turned a serious and tragic investigation in to a circus, and they have given the defense attorneys enough fodder to future appeals that will even give the attorney's grandchildren something to watch. The is no law that requires law enforcement to talk to the press, and this is the reason why. If these investigators were working for me, I would removed them from the case and have them writing parking tickets on graveyard.

After listening to the 911 calls, hearing Casey Anthony telling the 911 dispatcher, "I went through "other resources" in trying to locate Caylee... I realize that was not the way to do it..." Please!!
What other resources, other than contacting the authorities, could possibly be of ANY help in locating her daughter???
No Mother, in her right mind (I'm not saying Casey was out of her mind, she was way to calm on the phone.) doesn't report her child missing after 2 hours, let alone 31 days!
I agree; take a plea, save the Fl. taxpayers millions of dollars, you selfish, narcissistic, unbelievable excuse of a Mother!

This whole family ought to be prosecuted. There is a baby that has been killed and noone is doing anything in that family to let her murderer be brought to justice. Today watching Lee mouth to Casey that he loved her was sickening. Are they sure he is not the Father. The whole family should be prosecuted for Accessory After the fact, since they are all lying about something and the secrets need to come out. This is bigger than we all know, but one thing is for sure someone or all of them will fall. Why was there so much emotion displayed by Casey when Lee took the stand and total disgust by Biaz??? makes one wonder.

i tried to tape the court today, but only got the beginning of Cindys testamony. i will watch tomorrow & get caught up. My biggest problem is with Casey. She sits there every time she is in court, fooling with her hair. That tells me, it is all about her, still. What a mess!!!! Instead of being worried about her baby, what she is putting her parents and brother thru, she just wants to make sure she is beautiful. Looks to me, that is what she has always been concerned about, What an egotistical, selfish person she is.

I believe Cindy Anthony is telling the court exactly what she wants them to know. She sure did use the the term, "I don't remember" many times. I am soooo happy the judge decided to allow the phone calls, this will give the jury a true picture of what happened!!! I understand what kind of position Cindy is in, however, she owes it to Caylee.

regarding today's question, Cindy did what every loving grandmother or mother would do when your child is missing. we have an old saying in greece "you love your children, but the grandchildren twice as much". it doesn't matter if the phone calls were detrimental to casey's case, that child was missing, and now she is dead. whatever happened while casey was on drugs? not sure, she needs to come clean, and go after who helped her get rid of Caylee in that manner. Caylee deserves justice instead.

I think that Cindy Anthony is being very careful as to what she is saying-she says that she does not remember certain things, times, etc. I know if this was my granddaughter that had been missing for a month, I would remember EVERYTHING! I would want justice for my granddaughter! If my child had a chance of going to jail, or get the death penalty, it would not matter to me! Murder is murder-it's wrong! The expression on Casey's face is chilling and telling, to me. I am not buying Cindy Anthony's testimony. I don't think she's telling all.

how can Vinnie ask if we feel sorry for casey;s mother, I feel both the grandparents tried to cover up for their hateful daighter, I believe they knew where the poor child was dumped. I also believe it was;t long after the 911 call that the whole family knew Casey killed her daughter, Lets get on with this, they have tried this entire case already, Casey is GUILTY and deserves the death penalty,

The defense wanting these 4000 some doc.s To me shows they have nothing.....
911 calls will come in.. they have too.. they are excited utterances..

I really think that Casey accidentally kill her daughter with that ether. residue found in trunk shows ether was in play..Casey probably only wanted Caylee to sleep while she went out for the night and things went wrong...

If that is what happened she needs to come clean for her own sake..

I am relieved to know the tapes will be allowed into the trial. I think all evidence should be admitted. It also bothers me the way case sits there grinning at the younger attorney and their interaction. The sly grins and half smiles make me sick to my stomach...she needs to be thinking about her beautiful baby that she did away with because she was in the way. Why don't these people give their kids to the grandparents instead of murder them???? I will never understand it...not ever.

I am so glad she has had to control her nasty mouth in front of this new judge, I don't think he will tolerate her. as for George, Cindy has him browbeat along with the brother.

Why is Justice taking so Long?? It was Extremely hard to Watch, Casey Anthony, sitting in the Courtroom, Acting like She was waiting on a Pizza to be Delivered. Frankly, the only time Cindy Anthony ever told the truth in this case is ON that 9-1-1 tape! She lied under oath during this hearing and I hope the first police interview tapes impeach her at trial and she gets charged for lying under oath...I hope she enjoys being locked up, too! If casey had a job wouldn't casey claim caylee? also george seems very uncomfortable lying, cindy on the other hand seems like its second nature to her! Also a word of advice to cindy- get rid of the gum! It is very disrespectful in court! I don't know anyone who would go 31 days without reporting her child missing except someone who made that child go missing! Caylee needs justice – state of Florida please don't fail her !!!!!!!!!!

I know Casey Anthony is innocent until proven guilty. The circumstances and evidence speak for themselves. The prosecution can not take a case to trial without sufficient evidence to support his or her case. Cindy's 811 call tells a story. I know she has lost her grand-daughter, and the thoughts of losing her daughter just terrifies her. What she must realize is it was her daughter's actions that has gotten this case to this level. We want so bad to protect our children. I feel in Cindy's efforts to protectt Casey, she has actually hurt her in the long run. Casey expects her parents to continue to pull her out of trouble. This may be the one time no one can pull her out. She may have to finally suffer the ultimate consequence for her actions. When we keep pulling our children out of the same thing no matter how small, it only leads them to trying to do more, eventually leading to more destruction with each level of negative behavior.

I truly sometimes do not understand our justice system.!!!! Why are Fla. taxpayers allowing this young woman to use their hard earn money so she can have all these lawyers on her defense – so they can
defend her and get her acquitted. (or try to )
I have never heard of a child missing and a mother does not report it...
I have raised 4 children and taught them morals and values and sent them out to the world expecting them to follow what they have learned.
And also told them there would be consequences if they went against them. I don't know as a parent how you can stand up & defend a child whom you know killed her own child.......... What moral and values were set in that family ?????No matter how you look at it, one life is gone (caylee) and the other life if she is spared the death penalty will likely be in jail for the rest of her life....

I've followed this case from the beginning and always wondered how they could all live under the same roof, but it took one month for even the grandmother to call 911. In any case, it's clear that the Anthony's will put a story out there, a lie and blame anyone or anything... hoping one of the lies will stick or at least that if they weave enough of them, perhaps they can cause confusion to the public about what to believe. Fortunately, the public can see Casey is guilty. It's obvious on many levels. The family is controlled in a large part by Cindy. Cindy & Casey fabricate reality & put pressure on George to go along with all the lies try and save Casey's hide. So much for George being an honest police officer!! Double standard, I guess. Poor Caylee. No one in this family really ever loved her. No one seeks justice and truth for her. Casey needs to fry for what she has done. Poor little baby Caylee. What a horrible family to be born into.
