Rockefeller trial: Closing arguments next

Posted: 10:29 AM ET

BOSTON, Massachusetts–The evidence is in, in the kidnapping trial of the man who calls himself Clark Rockefeller. Jurors will return to hear closing arguments next week before retiring to decide his fate.

Clark Rockefeller enters Boston courtroom

The last witness called by the prosecution to rebut defense experts said Christian Gerhartsreiter is not criminally responsible for the crimes charged, because he suffers from delusional disorder and narcissistic personality disorder.

Psychiatrist James Chu disagreed with the defense experts’ diagnosis of two disorders. Chu opined that Gerhartsreiter suffers from mixed personality disorder with narcissistic and anti-social traits. He saw no evidence of delusional disorder; rather, he thought the psychological test results pointed more to untruthful and exaggerated responses.

This is the first trial in which Chu testified as a forensic expert. As a result, he struggled on cross-examination when his lack of training in forensics (the intersection of science in the courtroom) was emphasized by defense attorney Jeffrey Denner.

Before Chu took the stand, the final witness for the defense completed his testimony begun on Wednesday. In addition to a clinical practice, forensic psychiatrist Keith Ablow is a cable network contributor and writes a blog for them which he characterized as “journalism/entertainment.”

Within days of Gerhartsreiter’s August 2, 2008 arrest, and six months before he was hired by the defense, Ablow wrote a blog assessing what was known at that time about Gerhartsreiter. He noted narcissistic characteristics in Gerhartsreiter and wrote that he would like to know if it is rooted in painful childhood experiences.

During his testimony, Ablow explained that Gerhartsreiter was shunned and demeaned as an adolescent by his father in Germany. The source of this information comes solely from Gerhartsreiter, who is not known for truth-telling. Assistant District Attorney David Deakin suggested that Ablow had “interviewer bias” once he became a defense expert; that is, that he looked for a painful childhood experience and credited Gerhartsreiter’s words with no further confirmation. Ablow denied that he was biased.

Ablow appeared to blame ex-wife Sandra Boss for Gerhartsreiter’s worsening mental illness. “I wish he was married to someone who said, Look this Rockefeller stuff…we need to get you help…you’re a father now.” Earlier in his testimony, Ablow also said that the more people around Gerhartsreiter believed his lies, the more severe his disorders became.

Closing arguments are scheduled for Monday morning.

I wonder what Congressman Rockefeller thinks of his fake relative .

b ro   June 5th, 2009 12:23 pm ET

Hi, Jack - I just heard the discussion that if "Rockefeller" is found guilty, he may not get a very long sentence because parental abduction is common and the child was found and not injured.

I bet that he is sitting there quietly because he expects that he will get a light sentence. He could expect to laugh at his wife and her earnestness.

Oh, I guess that he ought to be aware that he will have to deal with the dead people in California sometime. But his flatness may well be in hopes of all this stuff going away. That he may get away with things.

Richard Staples   June 5th, 2009 12:48 pm ET

I'm offended by Jeff Fenner's insistence that the defendent be referred to as Clark Rockefeller. He knows his real name.

Are Sandra Boss's funds paying for the faker's defense or some other victim?

Michael Imbriani Sr   June 5th, 2009 1:49 pm ET

I want to know why the court is allowing this man to be referred to as "Clark Rockefeller". That is not his real name. He should be
referred to by his real name, Christian Gerhartsreiter. They are just feeding his lies.

Vivian Sullivan   June 5th, 2009 1:52 pm ET

Jamie , did I miss something? I thought that the wife was well educated and pretty savey. It seems she should have checked the defendants background even in a small way over the years .How does this happen to smart people ?? thank you

Diane   June 5th, 2009 1:59 pm ET

If in fact this gentleman was delusional and believed himself to be a Rockefeller as his defense attorneys claim then I can't help but believe that he would not have given up that identity so lightly when he went to Maryland after the abduction of his daughter. Don't they tend to hold on to that belief no matter what?

Elizabeth Oliver   June 5th, 2009 2:08 pm ET

Isn't the fact the the fake Rockefeller changed his identity so many times evidence that he knew exactly what he was doing?

He's a weasel who was trying to act like an important person.

I don't know about Ms. Boss, but when I was a young lawyer, I worked all the time. It was hard to keep track of everything at home. Since she was making $2,000,000.00 a year I bet she was putting in some hours. Her con man husband was smart enough to live off her money. If I were on the jury, that's all I'd need to know. Too bad the jury does not know about the California murders!

Carolyn   June 5th, 2009 2:29 pm ET

I also want to say the Keith Ablow is an idiot., if he really believes anything this defendant said to him, and believed those fake tears. Wonder if Ablow even required payment for his services. He got free publicity for his testimony. How insulting to blame the wife for not getting the con man help.

GAYLE RITTGERS   June 5th, 2009 2:32 pm ET

THANK GOD FOR THE COMMON SENSE OF YOUR WRITER GUEST ...I DISCOUNT ALMOST ALLTHESE EXPERT WITNESSES
AS THEY ALL HAVE PERSONAL AGENDAS...I WATCHED THE ENTIRE TED BINION TRIAL AND WAS CONVINCED THERE HAD
BEEN NO MURDER EXCEPT FOR THE FORENSIC GOD BADEN
HAVING BEEN HIRED BY THE FAMILY .. WATCHED THE RETRIAL AND WAS DELIGHTED AT THE DEFENSE SHOWING BADEN TO BE
FABRICATING...AND I BELIEVE THE LAWYER WHO SAW LEE
PICK UP EVIDENCE AT SPECTER. I WONDER HOW MANY
INNOCENT PEOPLE ARE IN PRISON BECAUSE OF THESE ROCK STAR EXPERT WITNESSES. UNLESS IT IS AN EXACT SCIENCE, I
BELIEVE JUSTICE WOULD BE BETTER SERVED IF THEY WERE BANNED.

lola   June 5th, 2009 2:54 pm ET

re: the rockefeller trial. it looks as though gerhartstrieter has conned dr. ablow, too. that baloney about "child abuse made me do it" is really getting old. lola

Trish   June 5th, 2009 3:36 pm ET

Ashleigh Banfield's question of the day was whether viewers felt they could be fooled by a "Clark Rockefeller". I'd bet we all have crossed paths with such people & never found out. These folks lie to everyone to keep up their constructed stories. In two instances I discovered the name under which I knew someone was false. Fortunately for me, in both situations my contact with them wasn't intimate. When contact is tangental and a crisis doesn't ensue, how would one find out that their friend's friend, or the guy at the corner store, or a fellow student, is lying about their identity?

I also, couldn't believe Keith Ablow fell for Mockefeller's crock. This trial was a perfect illustration of the weakness of psychology as a so-called science. Even with substantial evidence that this guy manufactured & lived multiple identities, the defense could find educated people willing to testify that the defendant couldn't control himself.

Catherine Howe's theory that people buying Mockefeller's fantasy made it somehow real for him, and because he answered questions on *published* psych tests in a way that scores consistently with psychological disorders demonstrates a remarkable naivete on her part.

Cookie   June 5th, 2009 4:48 pm ET

what I wondered why Dr Ablow insisted on calling the defendant Mr Rockefeller since that was not his legal name?

david   June 5th, 2009 9:49 pm ET

After reading all the comments,I stand alone. If there is anyone to plead insanity and get away with it ,Rock is the only one who can do it..

chilynsha   June 7th, 2009 12:31 pm ET

some people have a problem excepting things the way they are and feel they have to lie to make them better. everyone knows 1 turns to 10 more and eventially it just gets to big to keep up with. I dont know alot about psycology but i do know right is right and wrong is wrong and maybe if he had been taught that growing up he wouldn't be here now.

I think that the lawyers are probably grabbing at straws to save this guys future but if the prosecution and the defence have both testified they agree he is mentally screwed up then why even continue the trial just through him in a hospital where he can get treatment and try to save his poor soul.

constitution does not state "must be dilusional" to not bee able to stand trial. I feel that if you have to be given medication that you were not on when the crime occurred just to be able to stand trial, that is a realy good sign of incompetence and the constitution does state that you have to be competent to stand trial for a crime.

kim , MI   June 7th, 2009 4:21 pm ET

my question is if this christian gerhartsreiter marries miss boss under an assumed name doesn't the marriage become null and void and that all the money that he has received from miss boss have to be returned because it was given and extorted under false pretence?

tammie gowin   June 8th, 2009 9:28 am ET

what did you tell your daughter about why you were keeping her from her mother

Cathy Lamb   June 8th, 2009 10:14 am ET

This man is a major con artist He knew and knows what he is doing. How can he say that he loves his daughter so much if he was straves her mother? And allows no heat in the house did he really believe that, this would not affect his daughter? I mommy is freezing to death than so is the liffle girl.He is not mentaly ill, he is coning even his attorney.
i think that his attorney is insain! He is speaking as if he really believes what he is saying. I am a paralegal, so, I understand that attorneys have to do acertain amount of acting to protect their client, but, this is so far fetched. HOW ON EARTH ANYONE not know who they are even a Rockafeller. I do not think that Sentor Rockafeller is happy about this.

Michael Imbriani Sr   June 8th, 2009 11:18 am ET

I hope the jury doesn't buy the defenses's theory that he is not accountable due to "mental" illness. This man planned everything he did from the time he entered the United States to name changes to fit what he was after to abducting his daughter and eluding the police. He is no more mentally ill than any other crimmanal.

Linda Harmon   June 8th, 2009 12:30 pm ET

I wonder how this man got married under his assumed name without any legal documents.
I have been divorced for over 5years and I know my ex husband's social security number is and all his medical records.
This case is something out of the twilight zone.

Mark   June 8th, 2009 1:11 pm ET

NGBROI – like a fox!!!!

klincos   June 8th, 2009 2:16 pm ET

I do not believe a "Long Con" can continue for as long as this one did. I truly believe that this man is mentally insane. Typically a con would not have the patience to sustain things for as long as he did. The key to his defense is the TIME he "fooled everyone"-one would have to be insane to live this con for so long.

Trish   June 10th, 2009 10:42 pm ET

Re the question of whether a marriage is void if one partner lies about his/her name – no, the marriage isn't void, unless one of the partners is already married. Not only did Gehardshreiter marry under a false name, it was reported today by Beth Karas that he never filed the papers they signed the day of the ceremony, and even the lack of filing doesn't void the marriage. If the marriage were void, there would have been no need for Sandra Boss to file for divorce.

As for marrying with documents. My husband & I got married in Oregon in 1994, and didn't have to provide any documentation of our identities at all. It's legal.
