O.J. Simpson denied new trial

Posted: 03:29 PM ET

LAS VEGAS–O.J. Simpson has been denied in his motion for a new trial.

I'm here in Las Vegas, where, in the first court proceeding since Simpson and co-defendant Clarence Stewart were convicted on 12 criminal counts, Judge Jackie Glass stated she had studied the motions for a new trial and denied them all.

As the hearing got underway, attorneys for both men complained to Glass that their clients were not allowed to wear suits to court, and were dressed in the blue uniforms of the Clark County Detention Center.

Simpson's attorneys based their motion for a new trial on seven main issues, including errors during jury selection, not allowing full cross-examination of witnesses and not allowing the defense to present their theory of the case through jury instructions.

Brent Bryson, attorney for Stewart, who also argued for a new trial for his client, based his motion on alleged juror misconduct.

I don't think anyone believed Judge Glass would reverse her rulings, but it is the first step in a post-conviction process that now goes forward with sentencing in December.

That is, unless Simpson's defense team is successful with a motion that raises, in more detail, the alleged juror misconduct issue. Simpson's defense attorney, Yale Galanter, says we will very shortly see a motion that will allege jury foreman Paul Connelly was less than truthful on his jury questionnaire, which the defense says amounted to jury misconduct.

In addition, defense attorney Brent Bryson stated in open court today that Connelly was terminated by his employer, Pepsi, for making racial statements. Galanter and Gabriel Grasso will ask Judge Glass for an evidentiary hearing on the issue.

If it is denied, don't be surprised if there is an emergency appeal on the matter to the Nevada Supreme Court. All of this is expected to be done before the sentencing of Simpson and Stewart, scheduled for December 5.

send oj to jail for life!!!!!!!!!!!!! he does not deserve the air he breathes

iekoop   November 7th, 2008 4:11 pm ET

Another attempt by OJ to not do time for the crimes he's committed. He should have learned by now that if you can't do the time, he shouldn't do the time. Go away with murder once, won't get away with anything again. I'm happy to say I live in the state that convicted this loser!

john baker   November 7th, 2008 4:25 pm ET

I believe that one has to do equity, to get equity. Everyone wants "fairness" for O.J., but there was evidence in the trial that he continually unfair in regards to court orders to turn over items in his possession to the Goldman's.

And, can the Nevada court take judicial notice of the California Civil verdict that found him guilty of Murder. Can Jackie Glass take notice in her sentencing of 0.j.? He now asks the court for relief when he's violated numerous Calif. Court orders.

Further, he made numerous phone calls in this case trying to manufacture a defense. And, then got caught in those lies. The court owes him nothing. He got a fair trial, and if the Juror lied....then so has O.J. for many years. He'll get the Max......that's fairness.

John Lennon   November 7th, 2008 4:51 pm ET

Of coarse judge Glass wouldn`t let a new trial come in! She dislikes Yale Galanter just like she does O.J. Anybody that can`t see that must be blind in one eye and can`t see out the other. She`s not going to admit to her mistakes! They had a jury forman that was fired for making racial statements on the job and also said he would have convicted O.J. thirteen years ago, is that a fair jury? I think judge Glasses conduct on the stand is as bad as that 425lb. judge that was on trial for misconduct. I`ve never seen a case where a judge treated the defense team like she did !!!

time to do the time, OJ.

OJ Simpson is a murderer who was not convicted. After that grave injustice, he went on to think he was above reproach which our system allowed. Now his attorneys are trying to get him off with technicalities. The system is seriously broken. STOP, he is a CRIMINAL. He broke the law of God and the country. Put him where he belongs, behind bars. He should have been put to death!

Lynda G. Lindblom   November 7th, 2008 6:30 pm ET

I watched the program, Jami Floyd- Best Defense today and was surprised that noone caught the apparent error in the defending attorney's attempt to put words in the Jury Foreman's mouth.

When he was interviewed, with other jurors after the trial, the individual asking the questions asked for the opinion of the individuals about their opinion of sentence, purtaining to the pending sentencing for this case. The foreman stated that he did not believe it was his place to answer that question, stating that he believed that decision was for the court to determine. The interviewer tried to get the foreman to give his opinion, using the example of OJ's initial trial and that many people had their own opinions that OJ should have been found guilty and given life back then. The foreman said "That was my opinion". His words, I believe, were misconstrude.

Those debating the defense argument for a new trial are claiming that the foreman said he thought that OJ should have been given a life sentence, in the interview after the verdict for this current case. I do not believe that was what the foreman was saying. He was simply responding to the question posed by the interviewer. When he said he thought the sentencing was not his to make, but that the court should determine that, his next response was to reitterate that "that was my opinion". He was not saying that he agreed with the interviewers statement that OJ should have been given a guilty verdict in his first trial, he was saying that when he said "the determination of sentence is up to the courts", that was his "opinion" He was simply reitterating that he should not be stating what he thought OJ's current sentencing should be.

It is a great defense attempt, at proof of a lie on the foremans original questioning for being seated as a juror, that immediately following the verdict he was now saying he thought that OJ was guilty in the original trial. However, I do not take his followup comment to be in any way a point of opinion for the original trial. The interviewer was the only one that brought that trial up. The juror was simply pointing out that his original comment in this interview was "his opinion" for sentencing in this case. He was not stating that he agreed with people's opinions that thought OJ should have been put in jail, back then. He was just reitterating his opinion that the court should decide OJ's sentence now.

Isn't that what he is supposed to do? Where is the contradiction?

It was so obvious after listening to the interview with the Jury, that the foreman Paul Connelly could not wait to get the conviction verdict. He even said that he did not want to let the jurors go home because he was afraid that a juror will not come back the next day due to some unforeseen problem that might happen. He even kept the jurors until 9 PM at night to come with this verdict. It was also very obvious all thru the trial that the judge took the side of the prosecution and favored the prosecution. Clarence Stewart should have gotten a separate trial. In the trial of Alejandro Ferrer and Heizel Gonzalez-Martinez, not only did they had a separage trial, but even a separate judge for each trial.

Goodbye OJ. It's been a great civics lesson watching your Murder trial, Civil trial, and Robbery trial.

Alex Masonry   November 7th, 2008 7:43 pm ET

It looks like OJ Simpson will be getting off due to the alleged misconduct and lies of the jury foreman who apparently got fired from Pepsi for racism.

Donald   November 7th, 2008 8:59 pm ET

I am a Las Vegas resident. Judge Jackie Glass was so apparently unfair to Simpson for not letting him wear a suit in court Also, the jury foreman, on open TV, after the trial stated that Simpson should have been convicted 13 years ago and they waited until the 13th hour to go down in history as a conviction for Simpson..

Bruce   November 7th, 2008 10:04 pm ET

I don't think any of this comes as a surprise. While I happen to disagree with the severity of charges that Simpson was found guilty (I don't think the guy deserves to spend the rest of his life in prison for this particular crime), Judge Jackie Glass seemed to rather enjoy her 15 minutes of fame and I can't imagine that this woman would voluntarily reverse herself on a single ruling. This woman seems uncompromising and I would not want to be in her court as a defendant. I don't think it will come as any surprise then that on December 5th, the sentencing date for Simpson, Judge Glass will no doubt be handing down a very severe punishment (remember, he has no criminal record, he's a first time offender) for O.J. Simpson. Did he kill his wife? who knows, but he was not conviced of that crime. If anyone thinks that this will not come into play in Glass' court room, stay tuned.

N. Michael Hoghoughi   November 7th, 2008 11:32 pm ET

Can anyone shed some light on how this dirtbag pays for all of his lawyering? For them to be digging up all of this stuff that they're trying to use to get him off the hook costs big money - just a TON of billable investigation hours. A real mystery to me.

Devon Lemire   November 8th, 2008 12:53 am ET

Give me a break. This Clown is a "GANGSTA THUG" and he is going to do the time ,because he did the "CRIME" The good news ,once he is locked up, we won't have to see his name in the paper every other day. Let's get on with our lives people.

June Bell   November 8th, 2008 9:38 am ET

Great writing. Both defendants think they are above the law. I was so pleased when bail was still not allowed. It appears that the attorneys are grasping for straws. Mr. Connelly has the right to express himself outside the courtroom. I don;t think for a moment that he is really prejudiced, Just the opposite. As for a fair and impartial trial .... well it just isn't possible. O.J. has gotten away with murder and the vast majority would like to see justice, including me. O.J. thinks he is above the law so it's time for him to learn otherwise. I DO wish they would stop playing the race card. It doesn't matter what COLOR he is just his actions, which are criminal. Thank you,

Louise Curry   November 8th, 2008 12:17 pm ET

what comes around goes around , here we go again with racial reasons , i believe oj simpson implemented the whole thing, guilty now stay in jail

Kana   November 8th, 2008 12:50 pm ET

In the US everyone has the right to a fair trial. If the trial was prejudiced in any way than a new trial should be granted. It doesn't matter if the defendant is a high profile celebrity or the average citizen.

leisa   November 8th, 2008 2:17 pm ET

O.J. is do not matter if your claims are valid and true they have you where they want you at this point and therefore they will deny you all the way. Last alternative is to raise Johnny Cochran from the grave and get him back in court.

This "judge" Bias Glass was never going to aprove a new trial as it would like admitting she made the wrongs. She is highly bias towards the D.A. and the police. The Las Vegas Police Dept. are liars also. The jury's foreman, Mr. Clean, is a racist and a liar also. How can this judge admit her mistakes and her bias? NEVER IN A MILLION YEARS, PEOPLE!
Everyone complimented on how she kept control of her court, by acting very mean and rude to the defense attorneys, she was disrespectful to all of them, treated them like children and she is the mean third grade teacher, oh, come on! Superior Court: give new trials to both defendents. Go Mr. Galanter, Go Mr. Bryson!!

Kathleen Bennett   November 8th, 2008 3:56 pm ET

Give us all a break! Everyone deserves a fair trial but OJ Simpson has once again pushed the limits of the courts integrity. At one time he may have been a great football player but has no pass to invulnerability in the legal system. Simpson seems to feel he can do anything he likes, murdering people, staging a robbery, requesting endless privileges beyond the bounds of society. A self-deluded, self-important man.

Jonathan Manson   November 8th, 2008 6:14 pm ET

In most instances appeals can be difficult but voir dire in this case was rushed and it is hard to see why when the original press/media guide for the trial had the trial lasting until October 17. Juror questionnaires were also incomplete and had answers indicating that prior verdicts could prejudice findings, defense was admonished repeatedly and prosecution introduced the civil trial findings into this trial, and evidentiary issues exist as well,

Tom in MI   November 8th, 2008 6:33 pm ET

For god sakes!! Be done ith this man. How much miney has this cost the government? He's a low life and believes that he is above the law. He committed the crime, he was caught, guilty as charged. Now deal with the consequences.

aloha- to me i think that white jury in stewart and simpson trial was full of garrabage and so is judge jackie glass and the las vegas police and the districat attorney from the very begging when this trial started.2- as for the jury formen he is a sucm. he snd he fellow jury did not tell the truth to the media at all right in the court room right after the trail. and the jury was on dr. phil show and all of them the jury did tell a lie to dr. phil on his show.simpson deserve a new trail and judge glass was not fair at all and so was this jury and the police and the districat attorney.

joni   November 8th, 2008 10:28 pm ET

Well, at last, OJ isn't going to get out of this one! All his "fame" and "money" can't buy him a new trial or new attorneys or a new Jury.
Good for Judge Glass! Too bad she didn't sit in the Judge's seat years ago, during the murder trial of Nicole Simpson and Ron Goldman, Maybe that trial wouldn't have been such a joke and a circus, with Judge Ito allowing so much crap to go on.

Kat McGuire, KS   November 8th, 2008 11:53 pm ET

Yeah for justice! None of ALL his victims in the past had the rights to ask for a new trial.....they are dead or dealing with being his victims. I hope you rot OJ Slimeball!

I think judge glass is a pure racist and has it out for OJ simpson,
he is at the mercy of a female judge that is looking at him , holding him and could not wait to get him for a murder trial that he in fact has
been cleared of 13 years ago . OJ , yes is stupid for allowing himself
to end up once again in the hands of the law ' however , what he is jailed for is simply stupid and shows that the courts and jury and judge are all part of a plan to end this mans life because they think ' he
ended the lifes of 2 others . . yet he's been cleared . I really feel sorry
for this guy and that he allowed this misfortune to happen to him .

lofound99   November 9th, 2008 5:11 pm ET

He needs to go to jail and stay there until he dies and is removed in a coffin.

Tammy Lynn   November 9th, 2008 5:34 pm ET

I f anyone is charged with discrimination charge it should be O.J. Simpson.
I like how his white Attourneys who defend him in court keep selling the descrimination tool to get him off.
O.J. simpson walked out on his beautiful black wife a daughter for Nicole Simpson a white woman.
The first simpson wife works at walmart to pay her bills.
O.J. and Nicole lived in luxury and Nicole was loving every minute of it until things went bad.
O.J. and Nicole were having a love relationship and thats what ended his marriage to first wife a good loving, beautiful black woman.
After the slaugter of his Wife Nicole the white woman he then hooked up with another white woman that looked alot like Nicole.
O.J. Oldest daughter even went and stood next to his side after he walked out on her and mother.
O. J. daughter attacked him a few months ago and they reported she pulled a knife on him and Nicole look alike girlfriend.
Lets see if his daughter is stupid enough to be used by O.J. again in the feel sorry for me court system. I need to use you to get out of jail , but I cant give you money because I need it for my wild sex toy women.
O.J. only dates white women who look like porn stars, so who is racist?

Tammy Lynn   November 9th, 2008 5:40 pm ET

O.J. almost caused a serious riot in the streets using the race card to turn black people against white people and then he hooked up with cheap looking white women and walked away with a big smile.
O.J . You are a sick person creating bad energy in our world and you deserve to pay the time for the crime you have committed.

steve kiefer   November 9th, 2008 10:14 pm ET

OJ Simpson needs to give us all a break here. He's guilty of this crime. He has been found guilty. He needs to thank his lucky stars that he wasn't convicted of murder in his first brush with the judicial system. He is several fries short of a happy meal if he thinks that he was wrongly convicted of this crime. We all heard him speaking on the recordings.

Kraig Rasool   November 10th, 2008 11:15 am ET

Although I have very grave concerns in dealing with Mr Simpson I
doubt that he had a fair trial...Remember he was lamented in televison history when he was in a slow chase during his attempted
runaway from police after the murder of his wife Nicole....so anyone
(though they say differently) who saw this and watched the trial on
television will have a slighted opinion...Lets just say I wouldnt want
a jury of my peers to decide my fate if I were in that situation. Now
that it will probably go to the supreme court in that state, there might
be a little more room to take different approaches.

Get off the race card it’s moot!

John Lennon   November 10th, 2008 8:12 pm ET

I find it amazing how people can condemn somebody like O.J. when they have NO FACTS !!! I wonder if they would want to be treated like that ? I don`t think O.J. is an angel by no means but how you can convict someone by flapping your gums talking trash about him with NO PROOF !!! Now if you think his last trial was fair, the question i want to ask is what part of "IN SESSION' were you watching , the commercials? If by chance you or someone in your family gets in trouble and gets treated like that you probably will cry like a little girl won`t you?

J L   November 11th, 2008 1:27 pm ET

anytime you have an all white jury convicting a black guy, he will be found guilty and shown no remorse. i hope the judge feels haunted for the rest of her life for trying to get revenge for people she never met.

Chris Wolf   November 12th, 2008 7:21 pm ET

people who live in glass mindsets shouldn't deny categorically

Spider   November 13th, 2008 11:44 am ET

John Lennon-

I didn't watch the trial, not even the commercials. But, this was a situation where a man was accused of conspiring with a group of thugs to barge into a hotel room and intimidate a couple of guys into relinquishing some property. Simple as that.

A tape recording of the encounter, security videos of the group arriving at the room with the defendant, testimony of people present in the hotel room. How is that NO PROOF? In fact, how much more PROOF do you need?

As I mentioned earlier, I did not watch the trial. Were you sitting on the jury or on your couch? Watching the trial from your living room allows you the benefit of TruTV's talking heads with their own biases and the opportunity to get up and get a beer. The jury did not have those advantages. Questionable advantages, at that, when you're trying to make a decision about guilt or innocence. They listened to all the evidence and made a decision. They decided there was enough PROOF to find O.J. guilty, and their opinion is the only one that counts. Like it or not, that's how our system works.
To be honest, I really don't care about O.J.'s acquittal 13 years ago. I don't have an opinion about his gult or innocence in that trial. The jury decided that one too. Many people have struggled with that decision for 13 years now. Looks like those of you who disagree with this verdict will have to struggle with it for the next 13 years. Or more. Have fun.

Pat Green   November 13th, 2008 11:14 pm ET

TAPE RECORDER!!! Case closed.

cheryl harold   November 14th, 2008 1:15 pm ET

I think that O.J. got what he deserved. He got away with murder the first time and his children suffered the loss of their mother. That is just not right. He should have been put in jail after he laid his hands on his wife anyway and the key thrown away then and then all of this would have never happend. I know that everyone deserves a fair and just trial but come on. How much money is going to be spent on trials for OJ? If it were anyone else in the same position they would just have the trial and that is it but because it is someone famous they are willing to spend all kinds of money and that is what is wrong with society today. To much money spent on needless things...

biggs   November 14th, 2008 2:11 pm ET

John Lennon   November 16th, 2008 8:23 pm ET

Spider First of all i want to be a man and take back the smart comments i made. I think you might have gotten confused obout what i was saying or maybe i didn`t word it correctly. What i meant about no proof was on his trial 13 years ago, the prosecutors and the jury didn`t prove him guilty but people are yelling that he is guilty.I don`t know if he is and no one else does either. As far as the last trial, i`m not defending O.J. , i`m upset with the system . The judge would`nt allow the defense question the jury in depth so they were stuck with what they got. Judge Glass also favored the prosecution side and that turned the whole trial into a joke. It upsets me because if you or i or anyone got in trouble, would we get a fair trial? I know they had proof in the last trial, it`s just the unfairness is what i`m upset about not because it`s O.J.!! I hope i explaned it better!! Let me know if you will.

eual   November 17th, 2008 8:02 am ET

SICKOF OJ"S ANTICS   November 17th, 2008 4:28 pm ET

I had read (ages ago) that when OJ grew up in the projects he had loved to fool the cops with his lies when he got caught . (this was prior to the Nicole story) He got by because he was engaging and likeable.. Eventually the TRUTH does prevail,

Spider   November 18th, 2008 10:55 am ET

John Lennon-

Thanks for elaborating.

My personal hope, actually opinion, is that you and I would have gotten the same fair trial and the same decision in this latest trial.

The only thing that even remotely smacks of unfairness is the sentence. I have heard people claim that O.J. stands for life in prison for this offense. That does seem a little overboard. But, the sentence has not come down. We need to wait another month for that. Also, O.J. is somewhere in his 60s. If he gets 20 years, is that not tantamount to life in prison?

Fairness, in the American legal system, is a relative thing. Who's side your on usually dictates your idea of fairness when the decision comes down.

No matter what happens in the trial. There is still no question but that OJ committed another crime. Does it rise to the level of the murders he committed in 94? No! But, he can not walk into someone's hotel with guns and screaming at people. Even if he was after his own stuff. What would happen if people did that all the time? That would cause some real problems!! What if the gun went off? This sorta stuff happens all the time. People pull out a gun to try and scar someone and it goes off!!! You just cant do this stuff. He did break the law! So even if he does a small amount of time, he should!

Pamela   December 2nd, 2008 11:04 pm ET

guilty guilty guilty oj needs to be taught he is not above the law. he seems to always slip under the legal radar, since we have him in a position to teach him. we need to do just that. i feel a little time behind bars would be good for him.

Tom   December 6th, 2008 11:09 am ET

OJ will not last to his first parlor hearing because he will find Nicole and Ron’s murderer in his tin plate mirror in his jail cell. I am surprised he has lived this long with his self. Others go through the same life’s events with fear of our final judgment before God where all accounts will be squared, and restrain with great efforts not to take the Laws of God and man for our own vindictive adjudication.

LONNIE   December 6th, 2008 2:02 pm ET

At least 9 years before going before the parole board. That should give him enough time to finish his book "Why I Did It" Remember what happens in Vegas, stays in Vegas.

m. samuels   January 29th, 2009 12:43 pm ET

Yes, justice is finally served. He should have learned a lession the first time. Did he commit murder? Yes, he did. Was he convicted of those murders? No. Why? Because the police had failed to do things the right way. O.J. is where he belongs for all that he has done.

Make My Day in Arkansas   February 20th, 2009 2:24 pm ET

O.J. was convicted of armed robbery and kidnapping although he was not the person holding the gun. He got a life sentence. The men that actually had the guns walked away. How is this justice?

O.J. was once again on trial for the murders of Nicole Simpson and Ron Goldman. PERIOD!!!!

I am taken aback by the fact that the general public still reads anything partaining to O.J. Even when he was news, he wasn't news.
Are we that gullable as to be led by the nose?
That said, I had more fun when my computer crashed. There was the initiaI shock, but I knew, at the least, some one smarter than I was in control and could fix the problem.
O.J. reminds me of our government. Lacking both the desire and skill to fix the condition left there from another lifetime.
I'll make this as delicate as possable. With age comes a certain measure of knowledge and understanding. Now add O.J. and our governement to the equasion. What do you get? Answer that question for yourselves.
