Prosecution and defense rest in love triangle trial

Posted: 03:02 PM ET

BARTOW, Florida - Closing arguments are now scheduled for Monday in the trial of Alejandro Ferrer. Ferrer is charged with fatally stabbing Colin Zeiler during the early-morning hours of May 17, 2007.

Alejandro Ferrer in court Friday

Prosecutors rested their case after deciding not to call Heizel Gonzalez-Martinez, the woman at the center of the so-called “love triangle”, to the stand.

If convicted, Ferrer faces the death penalty.

In Session will bring live coverage of the closing arguments Monday morning.

Of course the prosecution decided not to call Heizel Gonzalez-Martinez. Her testimony would probably have helped acquitt the defendant when the defense attorneys brought out the possibility that she engineered the whole thing to cash in on a $500,000 life insurance policy. A half million dollar policy that, by the way, she sold to the deceased. Heck of a deal. Gets a percentage of the premiums paid and, now that Ferrer is gonna be behind bars, she won't have to share the face value either.

I think Mr Ferrer made a mistake in not taking the stand! If he was in a "fight for his life" the night this happened he needs to get up there and tell the jury exactly what happened. This guy is facing the death penalty! If he was willing to kill someone to save his life..One would think he would once again do all he could to save himself. I think this one's over and he's looking at the death penalty.

She won't be benefiting from the policy either as her present view is the same as Ferrer's . . . BEHIND BARS!!

Heizel was convicted of Second Degree Murder and Accessory.
She reached a deal and was only sentenced for her conviction on being an accessory after the fact. She is to spend 15 years in prison.

I would love to have heard him tell us why it took 40+ stab attempts to defend himself against an unarmed man. I agree with earlier comments that he should have gotten in the car and driven away instead of getting the knife.

debbie   October 31st, 2008 5:45 pm ET

Spider-Have you watched this trial? The Heizel woman is in prison-found guilty of aiding in the murder...She won't recieve the insurance..Ferrer is guilty of 1st degree murder period. He did it & planned to do it- NOTHING but defensive wounds on dead man.

debbie   October 31st, 2008 5:47 pm ET

He couldn't take the stand without perjuring himself.(If he claimed innocence or self defense he'd have been commiting perjury..)

donald   October 31st, 2008 8:30 pm ET

From what i saw of trial this is first degree murder. No self defence here.If it was he would have taken stand.I know jury will be told not to take this into consideration but come on its common sense. He went there with a knife with one purpose in mind-kill him.Shes involved in this someway also.

I don't believe the insurance company is going to dish out the half million just like that, they will try to investigate if its payable to the person that caused this man's death. This Ferrer probably will not get death but life without parole, as for her, she is kind of unatractive even, should had given at least fifty years, not fifteen, she was the instigator.

bob siracuse   November 1st, 2008 11:06 am ET

if her testimony would have helped the defense, why didn't the defense call her to the stand?

TYSON   November 1st, 2008 12:39 pm ET

The defendant drives an hour to a guy’s house at 4:30a.m. with a 12” knife. Has the mother of his child call and wake him up to lure him out then stabs him over 40 times and says it’s self defense. That’s a tough sell. This piece of garbage deserves to be put to death and will. My only wish it could be in a way similar to that of the victims.

Vixen   November 1st, 2008 5:43 pm ET

If I was facing the death penalty, I would take the stand and explain my side of the story. You would think he would know that he has nothing to lose at this point and anything he would say would be better than leaving the jury to what they 'think' has happened. I would do whatever it took to try and save my life if *I* was facing the death penalty......but then again......*I* am a law abiding citizen and would not be in this situation.

I have not heard very much about the keating savings and loan scandal and how it may affect this election
McCain-Keating Scandal Quietly Emerges as Campaign …
Sep 23, 2008 … John McCain’s role in the Keating savings & loan scandal of the 1980s appears to be quietly emerging as a campaign issue in the final …This subject has not been discussed in detail on cnn or Larry king Live.

I need to remind you that the Congress is reponsible for the purse and not the president, whom ever that president is or was

I believe Ferrer/Heizel went to Zeilers home to kill him PERIOD!! They had just gone to a movie and she then decides to tell Ferrer that Zieler had raped her??? at 4am?? I agree with Spider that she wants that $500,000. I doubt that Zieler raped her, but she had to think of something to get rid of him. She set both of them up! Why didn't she get life??

This case is horrific. Just raise your arm and replicate a stabbing motion 40 times. It takes far too much time to do so to be "self defense"! In addition, Mr. Ferrer seems to be smirking throughout the testimony in his case. His eyes appear almost to be laughing. Its despicable. I hope the victims family sees some justice in this case.

41-42 stab wounds is a bit of an over kill which is what they say is done more out of hatred and not self defense. I say QUILTY QUILTY QUILTY.

Sandra Halbleib   November 3rd, 2008 9:22 am ET

42 stab wounds in the BACK of the victim........doesn't sound like self defense to me. Ferrer deserves a harsh punishment!

Vegas   November 3rd, 2008 11:14 am ET

It was an accident... he was running with a knife, slipped and fell on him...

44 times!

I am having a problem with the "love triangle" belief.
I do not think that there was a love triangle. It seems to me that
the victim had moved on with his life and someone couldn't stand it.
I believe that Martinez had an issue with being bitter and it turned to
the dark side- she just found your typical "I'm a MACHO MAN" idiot to
twist around her finger. He was willing to be manipulated.
I am disgusted with the state that the woman is not sitting at the defendant's table right along with the brainless tough guy.
Ferrer is still trying to be a tough guy- he still does not seem to exhibit
any emotions even though he's on the "hot seat".
Way to go Ferrer!!! Keep being the tough guy!!

Spider   November 3rd, 2008 1:48 pm ET

debbie-Did her trial and conviction come up in THIS trial? That sounds like improper evidence. I stand by my original statement. She is the instigator. She may have not actually murdered the man, but Charles Manson didn't kill Sharon Tate either. You cannot be found guilty of, or even charged with, perjury if you claim innocence or self defense, even if you are ultimately found guilty. Maybe a little less TV viewing, deb, and some more education.
