Love triangel murder trial winding down

Posted: 09:11 AM ET

BARTOW, Florida - After only two days of testimony in the Alejandro Ferrer murder trial in Bartow, Florida, the case appears to be winding down.

Heizel Gonzalez-Martinez is the woman at the center of the "love triangle"

The prosecution will almost certainly wrap up on Friday, which means the jury of nine women and three men should begin their deliberations on Monday morning. If they convict Ferrer of the top count of First Degree Murder, the trial would then move into a penalty phase – where those same jurors would then be asked to determine whether or not Ferrer deserves the death penalty.

On May 17, 2007, the day victim Colin Zieler was killed, Alejandro Ferrer was interviewed twice by police detectives. The tape recording of his second interview was played for the court on Thursday and by the end of the interrogation, Ferrer concedes that he was the one who first introduced a knife into the altercation that ended in Zieler’s death. But to the end, Ferrer insists in his interview that he stabbed Zieler only in self-defense. It remains to be seen whether the jury will believe him.

In Session will continue its live coverage of the trial.

Does that so called judge remember this is 'America'? He was way out of line to scold her at all, let alone so downright harshly. He needs to come back down to earth & remember she lost her son to this defendant & that he himself is not above her or anyone. I am sick of these high & mighty judges. I hear more of this kind of thing these days....SHAME ON HIM!

I am VERY angry with the judge in this trial admonishing the mother of the murder victim. Since when dont familys of victims have the right to GRIEVE during the trial??? He should be voted off the bench for the cruel and uncaring comment. The mother has NEVER made a scene...cried out loud or drawn attention to herself in any way. This judge is as cruel as the murderer on trial.

HOW CAN YOU DEFINE SELF DEFENSE WHEN YOU STAB SOMEONE 40 TIMES? SOUNDS LIKE OVER KILL TO ME. HE MEANT TO DO IT.

margaret G   October 31st, 2008 12:24 pm ET

If this man had time to get a knife out of the car, he had time to get his self into the car and leave. This was not self defense, it was premeditated when he put the knife into the car and drove to the deceased house and called him out of his house.

I think the judge is wrong to talk to the mother of the victum as he did. Her son is everything to her, what does he think. I wonder what he would do if it were his child killed in such a way

I think the judge in this trial is too harsh on the victim's mother. In fact, he's the one who brought attention to her. I would bet the jury hasn't even seen her.

He should leave her alone and just concentrate on the case.

I have never seen a judge admonish a victim's relative for their controlled feelings. She appears to be doing her best. How dare he speak to her as he did. All he did was draw attention to her. I don't know how she did not respond unfavorably. Bless her and her family.

I agree that the judge was a bit harsh on the victims mother, but if the defense felt that the juries decision was swayed but the in court emotions of the victims family, it could well be cause for mis-trail and surely an appealable issue that could cause the defendant to walk.
The judge although harsh I believe was trying to assure that the guilty party had no outs.

I didn't think I'd ever be able to hand out a death penalty decision as a juror but I wouldn't have a problem in this case. He goes to the victim's house to "talk" at 4 in the morning, he brings a knife and he stabs the victim 40 times!!!!!!! That doesn't sound like self defence to me. The defendant says he was afraid for his life, what about the victim? He must have been afraid for his life as well.

As for the judge admonishing the mother of the victim, I can understand if the mother was wailing and moaning and the judge being afraid it could be prejudicial to the jury but from what I've seen, she has always cried quietly in the back of the court room.

Also, they said the testimony of the brother was flat and emotionless. I don't agree, I saw a young man struggling to keep his composure and of course he must have been very nervous. And let's not forget, not everyone cries and screams and rips their hair out, everyone handles certain situations in their own way.

I really feel for the victim's family, such a sad tragedy.
Rosie.

The final thing that makes me want to scream is the defendant and that dumb smile that is always on his face. He looks like he's convinced he's going to walk out a free man.

The mother shouldn't be there to look at the autopsy photos if she can't handle it. Her reaction will affect the jury. The judge should have removed her from the courtroom.

I despise the fact that this trial has been labeled "A Love Triangle".Martinez and Ferrer want you to believe this was the case , but it was not.Colin did father a child with Martinez , but the "love" was only for his child , Isiah. She repeatedly threatened him and used their son to coherse him every way possible. She forced him into the insurance policy and then she planned the entire scheme to have Ferrer kill him.She should die for her participation , as she was the brains behind the murder.Instead , she will be out of jail in 15 years to live out her life.

Colin was a kind and gentle person.I knew him well.He was a great father and loved his entire family and soon to be fiance. He had 3 other children that he dearly loved and he did everything he could to provide for all of them.He did without , so they could have a good life.

He will always be in our hearts and prayers.

When I watched how that mother's lip trembled as the judge chastised her to be viewed by all, I was sicken. If I was her ,just by him calling attention to her grief I would have bawled from the horror of the pure embarrassment. Our legal system is really screwed up for a judge to expect a mother or for that matter anyone from not showing any emotion.
in the lost of a loved one! Her face showed pure sorrow , a natural response to a horrific crime. The judge remined me of my ex and how he talk to me.......This should have been done in private and in a loving way so as not to upset her anymore then she now has to endure!

I do not believe he went their to talk but I do not think he went there to kill. If he had, after he slit the thoat he would have left. I think the 40 stabs is evidence of loss of control. I do not know if it was self defense or just loss of control but no one does but the people that were there. He had no record before, only someone real sick could plan this. I do not think he should walk but I do not think this is death penalty deserving because we really do not know for sure that he planned to kill him. It is easy for us to play judge and jury but we weren't there.
I think she made up the rape story to cause a problem, maybe for the life insurance maybe just for attention. Who knows. I think it is wrong that she got off so easy. Even though he did it, she didn't try to stop it, she should be right next to him.

He is an idiot not to defend himself if he wants to say self defense. With selfdefense, I think the defendant has the burden. I know by law they don't but jurors are just people.

I feel very sad for the brother and I hope he does not blame himself for not going out there sooner. If he had then he may be gone too. Just like all crimes of murder, the families always suffer the most.

I find it very interesting that the judge was ready to ask the mother of the victim to leave the court room, but if you look back on the closing arguments of the lawyer for the victim you will see people of the court LAUGHING and having conversation during the closing arguments.

Sue   November 4th, 2008 9:56 am ET

It was disturbing to see people who actually work in and for the court system to behave in the matter that they did. I hope the judge or someone reviews this! It is sooo sad that some people have no respect or care for other's and then take a life in this terrible way ,not caring how it will affect all for life.My prayers are with the family.

I enjoy watching your show on tv. I have a question that you may be able to help me with. Who is the woman doctor that testified on the Fred Cooper murder trial? What is the woman's doctor name?
