NEW YORK–We all need to be watching to see whether Casey Anthony’s rights are being respected in Florida. Because her loss of rights today impacts upon your rights tomorrow.
Casey Anthony Casey’s three-year-old-daughter, Caylee, has been missing since June. Mom didn’t report her missing until 31 days later. Casey has been charged with child neglect, filing a false statement, and check fraud; she’s out on bond in excess of $500,000 and on house arrest. The motion today was filed by the defense, in part, to keep prosecutors from testing the forensic evidence until the judge can set rules on how it should be done. Forensic testing, of course, can destroy samples; the defense simply wants the judge to oversee it. Why are they requesting this even before Casey has been further charged? Well, because hundreds of wrongful convictions have taught them that prosecutors can’t always be trusted, that crime labs don’t always get it right, and that judicial oversight is needed to protect a defendant’s right to a fair trial. Consider how the case has gone thus far. Casey’s jailhouse communications have been leaked to the press; but there are hundreds of pages of the official case file posted online; also on the web: audio of interviews between the cops and Casey. Meanwhile, at the Anthony home, protesters rant and rave and carry signs that say “baby killer.” Is this how we lay the groundwork for a fair trial? Of course not. Casey Anthony has been convicted in the court of public opinion, even before the jury has been sworn. She has a right, instead, to be presumed innocent. We all have that right, too.
