O.J. Simpson's defense case begins in Las Vegas

LAS VEGAS, Nevada—Lawyers for O.J. Simpson have begun presenting their defense against charges that the former football star masterminded a plan to steal personal items from two memorabilia dealers last September in a hotel room here. Alfred Beardsley, one of the two alleged victims in the case, returned to the courtroom as one of three defense witnesses questioned Monday.

Earlier, prosecutors rested their case, after gunman and former co-defendant Michael McClinton was questioned at length by Simpson attorney Gabriel Grasso. McClinton maintained Simpson intended for him to bring a weapon to the hotel room. “He wanted me to be security,” said McClinton. “He asked if I had a weapon’s permit and he knew I had a gun.”

McClinton, 50, conceded that he did not police investigating the case that Simpson asked him to bring guns along. “When you were talking to the police approximately a month after this incident, your statement to police was that he wanted you to go along as security, and that’s it?” asked Grasso. “That’s what I said,” replied McClinton.

Making one final push on re-cross, Grasso asked the question again; did McClinton tell police Simpson asked him to bring a weapon?

“I never told them that, but me and Mr. Simpson had…” the witness began, making an index finger-motion from his head to Simpson’s. Regardless of this “special telepathy” between the two, as Grasso sarcastically put it, McClinton conceded he never told police about this supposed request.

Simpson and co-defendant Clarence “C.J.” Stewart are facing 12 counts, including armed robbery and kidnapping, and face up to life in prison. They have both pleaded not guilty to all charges. Closing arguments in the case could be as early as Thursday, according to District Court Judge Jackie Glass.

Can someone explain to me why when Alfred Beardsley was
a witness for the prosecution he was brought to court in
street clothes?
However, when called as a witness for the defense today,
he was forced to come to court in jail attire and shackled.
Obviously, the prosecution is trying to discredit him by
this stunt , because he isn't saying what they want.
I guess only confessed armed gunmen get fair treatment
by the DA in Vegas.
I think if McClinton ever tried to tell the truth he
would choke to death on the words.
He was caught in yet another lie . He said he
always carries his concealed weapons permit
in his wallet. That's why he had it on him while
wearing his gym clothes. Yet, when the police
kicked in the door of his home , they found
the permit in the holster with the gun. So this
one time we are suppose to believe he took
it out of his wallet where he ALWAYS carries it
(according to him) and just decided to put it
in the holster where there is a spot for the
permit... PLEEEEEEEEEEASSSE

In Session should add to some of their (side) lawyers a few on the prosecution side so we might hear both sides of this fracas...and the announcers should quit trying to defend OJ...He is as guilty as sin, and it shows whether you give us your side of the trial or not...

I'm sure i'm not the only who has noticed that when the defense
makes a relevant point with a witness the judge's demeanor
changes drastically.
She interupts their questioning, refuses to let them ask very
pertinent question by constantly sustaining the prosecutions objections.
Also, she yells at them, tells them to shut up and sit down, belittles
them in front of the jury.
I have yet to see her behave this way when the prosecutors are
questioning a witness. Everything is please and thank you with
them. Even when they have ignored her few rulings in favour of the
defense and plod along questioning in the exact manner they want
that was objected to by the defense and sustained by the judge.
I hope she has a good chiropractor, she will need one after bending
over backwards for the prosecution throughout this whole trial.

So far the defense seems to be ahead. 1 only persons who would benefit by association with making tapes and living off OJ seem to have benefited from deals with the police.

2. No intent to steal what one owns has been provided by any witness. The alleged vitoms do not say on tape, OJ why are you stealing my things.

3. Police admit bias on tape.

4. Allege Victoms knew OJ was there in LV and so far orchestrate this debacle.

5. Its sad when Justice wich is depicted with scales and is blind to predijust actions against an accused person.

6. No Intent by the defendant has been shown, intent by the witnesses who readilly admit they were involved to get future gain through tape recordings. So yes there is a conspiracy. Yet not on Mr. Simpsons side!!!!

If he is guilty,then this should apply to everyone in america. everytime you go over the speed limit,run a red light, or find a loop hole in your taxes means your guilty and should agree to be setup to do 100 years because someone else was caught doing wrong. Of course that make no sense just like this trial.

Cashmore's attorney is outrageous to blame OJ or anyone else
for Cashmore's problems. Cashmore is not a baby.
He will make a fast buck as soon as this is over.
Cashmore does not seem to have had steady employment
prior to this. And his father probably has many many reasons for
not speaking to him. So grow up Cashmore and stop acting like a 50 year plus baby.

Thomas Riccio is one of the smartest men I have ever seen. As soon as he heard the idea of getting O.J.'s things back he took over and worked things out so he could make a profit. He planned on this falling apart. I believe he orcastrated everything between the two main parties so that the tension would create an explosive situation. He's a remarkable criminal. Not only has he escaped from prison again(so to speak), but he has also made a way to make millions from this.
Riccio planned this so well that he knew he needed to record everything. He knew he what they would be worth. He is so callous that he would even destroy his friends to make money.

Jami Floyd, finally, someone who believes in our jusicial system,
someone who respects the laws and rights of others given to us
by this great country we are all blessed to live in.

Don't let your dislike and/or hatered of a person make you violate them or their rights or deny them the right to a FAIR trial.
Unfortunately this judge hates OJ so much that she has left the
door open for an appeal. She is more concerned with being the
judge who put OJ, away even with faulty evidence and testimony.

Proof will be when this is over and you see her making money from it.

I find it so incredible that Beardley says in his 9-11 telephone call to the police that he was just robbed at gunpoint by OJ and his group but now states that he thinks that OJ should not be on trial at all. Gee, I wonder why. Hard to do a three sixty when your 9-11 telephone call says it all and gives the prosecution one of the best pieces of evidence to convict OJ.

Can someone answer this:

There have been many tapes played. All recorded by people trying to make money from this thing. Do any of the tapes that were recorded BEFORE they entered the room to recover the items have OJ saying anything about guns??

Bruce Formong, is not innocent.
He did not have any proof or a receipt for the sports memorabilia
that he was selling. If I was trying to sell items that belong to someone else, I would have to prove that I had a right to sell them
from the owner. Mr. Gilbert did not own those items. He did not prove that they were given to him by OJ. I don't care how much you hate they guy, I will never believe that he would allow any of those character to
have 40 and 50 year old family photos that belong to his mother.
That is something he would have kept and given to his oldest daughter or any of his kids.

None of this would have happen had, Gilbert not stolen OJ's things, Formong not been selling things that he did not own, Riccio, setting everyone up so he can get rich, OJ resorting to self help and running his big mouth, McClinton and Alexander hot headed ignorant behavior brandishing a gun. Everyone should have shook hands and went home. But the cops, prosecutor, and judge have an axe to grind and want their share of notariety and wealth. A waste of tax payers money.

Makes me wonder about OJ's thought process

I think the prosecution put on a good case. From what was shown on TV. However, they started slipping and leaving to many doors open for the defense. Further, if OJ has good sense he will continue to sit his old behind in his chair and keep making faces and talking to himself, and not take the stand. Although OJ has a right to take the stand and explain himself, he should let the expensive lawyers he paid do the work.

To some, OJ may have or may have not gotten away with some things (MURDER) in the last issues against him, but either way that issue is different than this present issue. In the sense that all the shady people involved in this issue are still alive to tell the story of what they believe is true or not true, as to what happened in that hotel room in Vegas.

Kathie: I agree with you on McClinton. He does not know how to tell the truth. Also, it's possible one of the Attorney's or even "Inmate" Beardsley may have petitioned the court for him to wear his street cloths. It's also possible they did not have time to dress Inmate Beardsley out for court. "yea right"! I also noticed the Judges denamor towards the defense. Hopefully the Jury is smart enough to see through the game in the court room and do the right thing.

I have to agree with many comments here. First, the judge has gone out of her way to make it difficult for a good OJ defense. She has done everything she could to belittle denese attorneys in the presence of the jurors. The evidence against OJ is so unstable it is hard to imagine that any right thinking person could bring in a verdict of guilty on anything. Disorderly conduct maybe. McClinton did not even tell the police that he had a gun with him of that OJ had asked him to bring a gun. This thing was a well planned setup but OJ made it easy with his behavior. I don't think he will ever learn. However, I do not have much faith in the jurors for obvious reasons.

For crying out loud.........the dude murdered his wife 14 years ago. Why would he care or have sentimental thoughts about pictures he could pass on to his children? LOL

I truly believe that this judge is bias as h ell! I don't think she conducting this trial in complete fairness. Its obvious she is in favor for the prosecution every objection she sustain for the prosecution, the defense she over-rules, I hope that OJ legal team is keeping notes for a lot of appeals! As for the jury , I pray that they use their brains and see through the self centered save my own behind accomplishes, let's get Oj he did it to help the prosecution worthless case! And Jamie Floyd you do a lot of talking, to many commercials, and give Riccio more fame that he don't deserves!!!!!

What is the legal distinction between offering money for witness prosecution testimony, as was done by the FBI in the Pam 103 Lockerbie case, and offering plea bargains to prosecution witnesses for testimony against the defendant?

In Nevada,when one person is found guilty,the accomplisist is also found guilty and sentenced to the same time. you do the crime found guilty,you must do the time in nevada. how stupid,oj,you get what you deserved,you wote the book,you are a crook,nevada scalped ya,and you DIDNT GET OFF THE HOOK!!! and yes, oj's past came back to haunt him this past week. now maybe the goldman and nicole family can finally say,its a bout time,justice has finally been served on all counts!!!

The more I review the verdict in OJ's case the more disgusted I get ,not to mention the embarrassment I feel as an American citizen.After care full review the more sick I get just looking how disgraceful the Judge was through out this trial. All her ruling appear to favour the prosecution all the way nothing for the defence. This judge should be disbarred for her handling of the case. I pray to the Almighty never let me have to be involved with America's justice system.I spoke to people from other countries who followed the case and all had the same response the results were a clear miscarriage of justice.The JURORS were all yellow bellied scared beyond their wildest imaginations that they would be chastised for the rest of their lives if they returned a different verdict. That is a crying shame and an act of cowardice in the true sense of the word.
One would expect that journalist would be objective in their findings and would offer constructive review of the case but it appears all were delighted to see OJ swing like a pendulum no matter what spin they put to it . What about the quotation "Let justice reign for all "
Make no mistake OJ is stupid he must have known America was after him so he should always be careful and not be reckless.Not withstanding his stupidity justice should be done and also appear to be done.

all the aparently guilty parties have beeb given immunity and the innocent party is put on trial. The DA and the entire staff on this case should be charged wit conspiracy that should also include the Judge whose handling of the case was deploreable. That is conspiracy to deny a man afair trial and obtaining information by means of bribery that is offering breaks to the apparently guilty parties in order to get their desired results without these guys there would have been no case.JUSTICE should never be able to be bought. that is an aboration of justice disgraceful and disgusting.

Its a screwed up case, the whole time people knew he was going to end up in jail. It is not a race issue, its more of a common sense thing. He should have stayed clean if he wanted to stay out of jail. There was no way he would make it through another trial and be found not guilty. God does work in mysterious ways, He pays for something that I believe is really not worth loosing his life over. But that is just how life works, everyone knows its the right thing to do to get back what you have lost if its stolen away from you. This is not that type of case because it involves a huge amount of emotions that its nearly impossible for anyone to control.
