Confessed gunman implicates O.J. Simpson

LAS VEGAS - A second gunman who admitted that he brandished a fully loaded semi-automatic handgun during the alleged robbery of two memorabilia dealers testified on Friday he brought the pistol at O.J. Simpson's request and was told by the former NFL star to "take it out and look menacing," just before entering the hotel room at the Palace Station.

Michael McClinton is expected to be the final prosecution witness

"My gun was drawn when I went through the threshold of that door," said Michael McClinton, who pleaded guilty to a charge of conspiracy and robbery. "He [Simpson] started screaming about his memorabilia. He said don't let no one out this room."

McClinton said he and friend Walter Alexander had met Simpson at the Palms Hotel earlier that afternoon, Simpson had wanted them to go along as security, and he agreed. He said Simpson had told them that there was a man [Thomas Riccio] an "inside Man" at the Palace Station.

McClinton testified that after Riccio let them into the room, "they filed in." He said he kept his gun out the whole time, loudly ordered people around, and described his position in the room as being so close to Simpson their shoulders were touching.

He testified that Alexander also drew his weapon briefly, which appears to contradict Alexander's testimony that he never took his gun out from his waistband.

He said the incident lasted about eight to ten minutes and when he felt it was time to leave, he signaled Simpson who was still ranting and raving, by squeezing his arm.

Following the alleged robbery McClinton said he and Alexander returned to his home where they changed their clothes to attend a pre-wedding party at the Little Buddha restaurant hosted by co-defendant Clarence Stewart.

McClinton said he brought a long a pocket microcassette recorder, because he and Alexander had discussed recording Simpson and selling the tape to the tabloids, but it became an exhibit for the prosecutors instead. An attempt to videotape the incident was abandoned when McClinton said he couldn't get his camera equipment to work. He testified he did not take the small video camera with him that night when he went to the Palace Station.

The 26-minute recording of Simpson's conversation with Alexander and McClinton in the hours following the alleged holdup was played for the jury. The men were heard laughing and joking about the confrontation in the hotel room.

"Oh, you saw me hollerin' at the boy with the New York shirt on," Simpson said laughing"…shaking like a mother f'er."

At one point during their discussion Simpson asked McClinton if he "pulled the piece out in the hall?

"I said no, no, no," McClinton testified.

According to the transcript Simpson then replied, "There ain't nothing on that video and look, they gonna look at the video. They're probably gonna look at that video. They gonna get all the video. Look at it before they decide what they gonna do. Ain't nothin' they can see, they gonna see us goin' in the place. Then they gonna see leaving with just the boxes.

Simpson also appeared to suggest that he wanted to keep his memorabilia out of the hands of the Goldmans'.

"And I knew, to be honest with you. I knew now the Goldmans would get it and sell it and so I, I told these guys do whatever you wanna do with it."

McClinton is expected to be the last witness for the prosecution. Stay tuned to In Session for continued live coverage of the trial.

OJ is as GUILTY AS HELL! Where is he getting the MONEY to pay all these lawyers.. ... probably hidden like his memorabelia as in this Case .. I only hope after this is over and he's found GUILTY .. The Goldmans Lawyer goes after OJ...

This comment is directed to the "question of the day"

I feel the recorded phone calls are are the most compelling because of their "tone" they help "us" understand the personality of "OJ" it is an ugly picture they paint. He is profane and seems the company he keeps. He does live the dream of being "bullet proof" right up until this year, I believe he will learn what it means to be held accountable for the first time in his life.

Is it not a violation of Nevada law for a party such as Mr. Riccio to record conversations between parties when he [Mr. Riccio] is not present during those conversations, i.e., recording the officers while they were securing the alleged crime scene?

If so, it appears that immunity for Mr. Riccio's actions and financial gain for his participation in the incident and possible life sentences for Mr. Simpson and Mr. Stewart is a grave injustice of the law!

Amazing. I supported this guy against the whole LAPD malarkey and police shenanigans that almost got him in jail 10 years ago. Now even I just wish he'd get somewhere and sit down.

This trial boils down to one thing: which one of the turncoat liars against OJ do you believe, the guy who set the whole thing up and sold the tape to TMZ for $100 grand or the guy who said "Sure, if I can get some money, I'll slant my testimony".

Good going OJ. Way to keep making us look bad.

If Mr. Simpson is not found guilty, then this jury has been paid off. He was guilty beyond ANY doubt of killing two human beings, and turned loose because of having a black jury. He does not have that luxury this time, so with the over whelming evidence, again against him, only money can set him free. O.J. Simpson is a narcissistic, sociopath, who will continue to commit crimes as long as he is free.

After listening to McClinton, the Prosecution has clearly proven the armed robbery charge beyond a reasonable doubt. The evidence is overwhelming despite some expected (in my view) minor inconsistencies (differences).

As to commentary about the questionable characters of the witnesses, clearly some of them are not stand-up citizens I would associate with. However, it is also clear they are OJ's associates and former buddies. What does that say about OJ's character and his credibility?

For the defense to suggest that OJ knew nothing about the guns and, further, did not see them in the room, is ludicrous, to say the least.
The kidnapping charge, while technically proven, is probably an over-blown charge which could have been left out. I am disturbed when defense attorney commentators suggest that OJ was set-up. OJ is a big boy and knows what he is doing. He was not dragged into the room screaming.

Anyone who actually thinks OJ isn't guilty of both crimes: murdering his wife and Ron Goldman as well as armed robbery lives in a dream world. The man is nothing but a punk criminal that somehow manages to beat the system. On his death bed, I hope it's his children that get to pull the plug on him–just like he "pulled the plug" on their mother.

It is obvious that O.J. Simpson was setup from the jump start. The question is, did O.J. commit a crime that would warrent a long-term sentence. It seems to me that he was goin got retrieve his possions, possions that he had asked the police to retrieve for him to no avail. Mr. Simpson was robbed and could not turn to law enforcement for help, which we all should be abile to do. The real guilty party is the police and the snitches that he had helping him.

Since O.J. was found no guilty in a court of law in 94, the white media, and law enforcement have tried to get this man on any and everything possible, this is just a witch hut, and if you (White People) who own the media and the police and you profiteer would admit this is true, at least I would say that you were being honest and showing your true colors or racisim.

O.J. never had a gun, and if he is guilty of anything in this case, its breaking down a hotel room door, becasue you can't steal what is already yours. If the police had done there jobs, this how this would never have occured.

Screwups In McClinton’s Testimony

1/ Nobody else said Riccio asked them to spread out.

2/ Nobody else said there was any conversation in
the hallway going down to the room.

3/ Nobody else said the gun was drawn as they entered
the room.

4/ If McClinton had the gun in his hand the whole time
how did he manage to squeeze OJ’s arm in the room to
tell him it’s time to go , like he said he did. He said
he had the gun in his right hand and squeezed his arm
with his right hand.

5/ During none of his conversations with OJ before hand
did he ever say OJ told him to yell at Riccio too , so
as not to blow his cover.. He adlibbed that on the stand.

6/ Both Cashmore and Ehrlich stated that they drove over
to the Palace Station in the car with OJ and CJ Stewart.
However, McClinton says when OJ and CJ pulled up and they
flagged them over that only OJ and CJ were in the car
and that they sat in the car chatting with them.

7/ McClinton never openly said OJ asked him to bring a
gun, he only said he asked if he had a concealed weapons
permit, because he wanted him for security.

8/ nobody else said they saw anyone get out of the car that
pulled up behind them once back at the Palms.. Only McClinton.

9/ nobody else said that Alexander had drawn his gun, they
said they saw it in his waistband only.

OK everyone with any intelligence knows OJ is a guilty man, but don't be surprised if/when he is set free again. Money talks and somewhere OJ is getting bankrolled. In our society that accounts for everything. It doesn't make it right, but it is the truth.

Mark my words: OJ will be found guilty of a lesser charge and spend little if no time behind bars. In a "free" society where money is everything, It is one of the pitiful prices we pay to live the way we live.

How come the defense hasn't asked why someone was tape recording the robbery? Was he wearing a wire so that OJ could be setup and/or convicted and/or prosecuted for getting away with murder before? Was a higher authority involved in this audio taped robbery?Or does OJ's partners in crime usually record their crimes for future reference? Was OJ tape recorded so the State of California could get a conviction to ease the public outcry for justice in the Goldman/Simpson murder fiasco?

This tape that McClinton made and they are playing is not worth listening to. It's to hard to understand and he never took the time to mention a gun to O.J. so it really doesn't tell us much at all...waste of time! The 2 gun men are going to lie so they can get their deals...They are the states puppets.

I realize a lot of people feel O.J. comitted a heinous crime years ago. I myself wish the answers were clear and transparent, but the man was found innocent by the law of our land so friggin get over it. If the LAPD had not done such a horrible job of that investigation this one wouldn't even be happening, but i never heard any of the O.J. haters screaming about that. This country is so full of racisim, greed and grandstanding. I'm not surprised that the economy and everything is falling apart around us. Now regardless of what went on in that room, it "was" a set up for one ( shouldn't someone be going to jail for that too?) and those things at one time did belong to Simpson. How did that dealer come into possesion of them and why is he not being investigated? I see this as another rush to justice with a tainted group of witnesses and prosecutors looking to make a name and a quick dollar off of a fallen and defeated man, who's name still commands world attention. As for OJ he needs to sit down, enjoy his retirement that is untouchable and take care of his children.

Had to add this. Can everyone not see that Mr. Riccio’s is getting nothing out of this but he started the whole thing. He did everything O.J. did and the others that did not have guns. It looks like a total setup but Mr. Riccio’s goes free...gets absolutely nothing. Though Mr. Riccio’s obviously made alot of money off the deal.

Makes Nevada look bad. Mr. Riccio’s goes free yet he started it and was there with everyone else. The things the police say while they are in the room....its obvious they are out to get O.J. They want to be the great state that put O.J. away. Thats crazy and petty.

We'll have to see if Mr. Riccio’s and the state of Nevada get what they want.

if i had commited a crime with "MR. Simpson" i would take a deal also. he seems to commit the worst of crimes and blames everyone for setting him up but never takes the stand to set the record straight. i beleive the jury, as i would, will see him for what he is. GUILTY.

O J did not have a gun in his hand. The guy that had the gun and has admitted it has cut a deal with the police for a lesser charge that does not mention any gun at all. It is obvious then that the police charged OJ with all those charges involving deadly instrument (the gun) so as to convict him this time to make up for charges they couldn't get him in the murder trial. Why is it that this guy McClinton all of a sudden under cross has selective memory?

For all you people with the same old song; "OJ was found not guilty in LA" , does not mean he didn't commit murder. The evidence was overwhelming!!!! He was just lucky enough to get a jury that hated the system and law enforcement. Remember the civil case found him guily, and so will this jury. The wheels of justice sometimes roll slow, but will surely catch up with you OJ, JUSTICE IS BREATHING DOWN YOUR SORRY NECK!!!!

I found it interesting in the afternoon testimony today when Mr. Beardsley testified for the defense that he was wearing jail clothing and was shackled. When he testified for the State he was wearing street clothing. Why is this? I believe the whole case has been slanted toward the State. The judge seems to be favoring the State. The defense can hardly get a question out before it's objected to and she sustains it. I hope the jury can see through this and takes into consideration how all the other guys got off with almost no jail time if any. I'm surprised the defense hasn't brought out the tape of the officers in the room that night making the statements about getting OJ in Nevada. Maybe they are letting it go because they don't believe the tape is totally accurate.

Riccio did not setup anything except a meeting with Beardsley and a nameless buyer who later turned out to be OJ. Riccio had nothing to do with OJ recruiting his friends, entering the hotel room and committing armed robbery. All the excuses and alibis in the world can not change those FACTS!

First , to Tracy Ga, if OJ was enjoying his retirement and taking care of his kids, he wouldn't be in a courtroom in Nevada. It's obvious that because he is greedy and believes he is above the law, he chose to retrieve his goods in whatever way "he" chose. Oops OJ, but don't worry with this farce of a trial...you'll walk.
Second, somewhere in Nevada, someone is laying odds on the outcome of this trial and will make money on it.
Third, when OJ does walk, does anyone want to lay odds on when he tries another stupid and idiotic antic and walk away from it again?
Fourth, I can't wait for this to be over. The expression on OJ's face, the shaking of his head as if he has no idea what anyone is talking about, and his smirk, takes me back a few years when he walked the last time. Best of luck to Mr. Simpson on his next adventure.

Why does so many people want O.J. to be found guilty, even if he is not guilty of this crime, but guilty of doing – being stupid. If you had a family member (mother, father, spouse, etc.) facing life in prison and carried out the so call crime just as O.J. did. And all except one person was given a deal to testify against your family member, same as O.J. Listening to the evidence up to this point, shoud your mother, father, spouse, etc. be found guilty and sent to Jail for life? I HOPE NOT, BUT THOSE OF YOU, WHO WOULD SEND AND INNONCENT PERSON TO JAIL. SHAME~~~!!!~!!!~

Something is not right here with OJ and his shady friends. While his friends were trying to be slick and implicate him "OJ", they opend the cell doors for themselves and possibly everyone else. If this potiential camara had of worked, my belief is this idiot McClinton would have used it. Why he would want to be on camera committing a crime is unknown to me. Further, after committing this alleged crime why bring a tape recorder to try and set somebody up? McClinton, don't drop the soap!

Did the police tell McClinton to do this? Because I Still think this man "McClinton" is a snitch. You know the police are some shady individuals too. If the police think they can get away with something unethical some but not all, will try. In the instance, it appears they are caught up in the mix too. It seems like all individuals involved in this mess including OJ, is one marble shy from the nut house.

Holding someone against thier will with or without guns is against the law. OJ simply saying "Don't let anybody out" constitutes holding someone against their will. Thats a crime. He may not be found guilty of kidnapping but he should at least recieve punishment for False Imprisonment.

Over 100 times? Wow, that is impressive. If O.J. walks on this case, you should see if you can be part of his posse. Your record would fit right in. Then, the next time he decides to violate the laws of our country, you can be there to roll over on him and cash in.

I think:I heard McClinton testified that alexandar ask him for the gun and McClinton said he made a mistake for giving it to him. what did o.j have to do with that.

I dont understand how important it is if OJ knew there was a gun or if he "saw" the guns. Does it really matter?. He was there during the robery there for guilty, no matter what his part in it is, just as the rest of them.Is Nevada's laws different?

This really makes me sick to know that many people in our society still can't see that there are still many mistakes being made when it comes to O.J. Simpson. Because of his celebrity and prejudice the first case was blown. (of course i forgot the victims were white) Many of you wont except the verdict of the justice system but you wont blame the justice system for not doing what all of you idiots paid them to do. O.J will never get a fair trial in this country ever again, Because in the court of public opinion anything he gets involved in he will be judged differently because of prejudice. he tried to get intervention only to be ignored, and that is always going to be his fate because people are narrow minded. LET ANY OF YOU WITH OUT SIN CAST THE NEXT STONE!

I totally agree with Tracy Ga, this is an obvious clam to fame for Nevada.But i feel that the jury has been deffenitly tainted, and if oj is found guilty of any of these charges i hope they appeal, after all they have plenty of cause. This trial was a joke. I think Kathie from canada sums it up really good, we need just one jurer like her.Maybe after this trial Nevada law inforcement can start concentrating on real crime, and not on some kind of race with LAPD or FLA.

Oj is guilty of nearly decapitating two people, he is also guilty now, but I think the prosecution got over zealous and might offend some bleeding heart liberal juror, which in turn might set the bum free....or get a hung jury. I hope to God I'm wrong!!!!!!!
If gets off this time, I will loose a faith in the justice ""simpson""
also...Jamie Floyd should not be saying he is innocent in her round about way. She is the only anchor that has become a juror in this case. I hope OJ gets what he deserves in prison.

laurie, it was also stated that the police and FBI were notified that an unauthorized sale of O.J.'s possesions would be taking place but neither of those agencies wanted anything to do with the case until OlJ. took action in his own stupid way. but can't you see how wrong it still is. what would you do if it was your family heirlooms (just for example) and you couldn't get help from law enforcement. You may result to your own vices too.

This is just getting old. If OJ gets off again will he do something else in another 10 or so years?
If his past meant so much to him MAYBE two people would still be alive today..........Hmmmmm.

I am a 30 something black american woman. When oj went on trial for the murders I was so happy when he was found not guilty because I believed in him. I have since changed my mind and i truly believe that oj is as guilty as sin. And because of our laws he cannot go on trial again. So if they can't get him for the murders I hope he is found guilty for this crime and put in jail for the rest of his life because that is what he deserves.

iam a black woman also and i strongly believe that O.J. is guilty of the murders i think that had the LAPD not tried to frame him and took the donuts from thier mouths and done some good detective work the verdict would have been different. but just as strongly as i believe in his guilt in that case i believe he was set up in this case and i cant see convicting him on evedince but i believe he will be convicted on the need to give us all closure in the deaths of nicole and ron however wrong that may be i think thats what will happen.

It's been thirteen-years, but I seem to remember that the Goldman/Nicole Simpson murder scene was a bloody one, brought on by cutting the throatsof the victims.

Since that time, I've watched many "Forensic Crime" shows and I am always amazed at the way the CSI are able to find just a single blood that was not "cleaned" away by the killer.

And anyone that has lived on a farm like I have, and witnessed the slaughter of hogs, knows that blood is spewn everywhere when the jthroats is cut and the hog struggles in the "deaththrows."

The killer(s) of Nicole and Ron had to have been covered in blood;that blood was never found on O. J.

I believe the witness accounting of the "four black-garbed Ninjas" and the "ritual drug killing" theory hasve more credence than any of the other evidence that came out of the Simpson/Goldman murder trial thirteen years ago.

This verdict is the reason that no one can believe in the Justice system any longer. Of course, it was a set up. That is the way the law works now.
